What FMCSA Clearinghouse queries must an employer perform?

Employers of CDL drivers covered by FMCSA drug and alcohol testing rules must use the Drug and Alcohol Clearinghouse as required by Part 382. Core duties include a pre-employment query before covered safety-sensitive work and an annual query for each covered driver.[1]

Why this matters

Clearinghouse compliance is not a stand-alone task. Query timing, driver status, required consent, employer action, and records all connect back to whether a driver can legally perform safety-sensitive work.

Owner-operators have an added layer

Owner-operators have both employer and driver obligations. FMCSA allows a properly designated C/TPA to perform certain Clearinghouse functions on an owner-operator's behalf.[2]
